These terms and conditions of services are a legally binding contract between the website user and School Road Publishing Ltd, which includes but is not limited to products that link to the site. By using the site, you agree to be bound by the terms. The site’s privacy policy follows, which also governs your use of the site. If you do not agree, please discontinue using the site. School Road Publishing reserves the right to change the terms at any time without prior notice. Your continued access or use of the site after such changes indicates your acceptance of the terms as modified. Your use and browsing of the site is at your risk. If you are dissatisfied with any of the materials contained in the site, with the quality of service, or with these terms, your sole and exclusive remedy is to discontinue accessing and using the site.
In order to utilise certain functionality of the site, you must complete a registration process. As a registered user of the site, you agree to (a) provide true, accurate, current, and complete information about yourself as prompted by the site registration form, and (b) update the registration data to keep it true, accurate, current, and complete. Upon completing the registration process, you shall receive confirmation of a password and user name. You are responsible for maintaining the confidentiality of the password and user name, and you are fully responsible for all activities that occur under your password or user name. You agree to notify School Road Publishing of any unauthorised use of your password or user name or any other breach of security; exit from your account at the end of each session; and defend, indemnify, and hold harmless School Road Publishing from any loss or damage arising from unauthorized use of your password or user name.
By registering, you consent to the collection of your data and processing of such data by School Road Publishing in connection with your use of the site. You consent to the technical processing and transmission involved in your use of the site, and you acknowledge that such process may involve transmission of such data over various networks; and modifying such data to conform and adapt to technical requirements of connecting networks or devices.
The site is owned by School Road Publishing. All of the content featured or displayed on the site, including, but not limited to, still images, text, pictorial works, video, graphic designs, audio recordings, multimedia combinations, and computer programs, including web-based programs is owned or licensed by School Road Publishing.
You agree to be financially responsible for all purchases made by you or someone acting on your behalf through the site. You agree to use the site, and to purchase services or products through the site, for legitimate, non-commercial purposes only. You also agree not to make any purchases for speculative, false or fraudulent purposes or for the purpose of anticipating demand for a particular product or service. You agree to only purchase goods or services for yourself or for another person for whom you are legally permitted to do so.
The site may provide, or third parties may provide, links to other sites or resources. Because School Road Publishing has no control over such sites and resources, you acknowledge and agree that School Road Publishing is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that School Road Publishing shall not be responsible or liable for any damage or loss caused or alleged to be caused in connection with use of or reliance on any such linked content, goods or services available on or through any such linked site or resource.
Any goods lost or damaged in the mail will be replaced by School Road Publishing (damaged goods will need to be returned before a replacement can be sent). Refunds will only be issued if School Road Publishing is unable to replace lost or damaged goods. Subscriptions may be cancelled and refunded up to 14 days before the next issue of the subscription is mailed. Please note that we reserve the right to introduce or withdraw a promotion at any time. During our 'Free Issues' promotion running from Thursday February 11, 2021 to 11:59pm Wednesday April 7, 2021 the number of free issues included will be added to the end of your subscription term. Should you wish to cancel your refund will cover any unmailed issues, excluding the free issues.
School Road Publishing makes no warranty that the site or any of its functions will be uninterrupted or error-free, that defects will be corrected, or that any part of this site, including the servers that make it available, are free of viruses or other harmful components. School Road Publishing neither warrants nor makes any representations regarding the use or the results of the use of the site or materials on this site in terms of their correctness, accuracy, timeliness, reliability or otherwise.
1. Information on how to enter and the prize forms part of these Terms and Conditions. Participation in this Promotion is deemed acceptance of these Terms and Conditions.
2. Entry is open to New Zealanders only and must be 18 years of age and above and must register via hello@scoutmagazine.co.nz. Employees (and their immediate families) of the Promoter and participating agencies associated with this Promotion are ineligible to enter. Participants are eligible to enter up to one (1) time.
3. Promotion commences at 12:01am (NZST) on 11/03/2021 and final entries close at 11:59pm (NZST) on 03/06/21 (“Promotional Period”). No further entries will be accepted after closing. School Road Publishing reserves the right to extend or terminate the competition for any reason.
4. To be eligible to enter, Relevant Persons need to submit an entry as follows or in such other form as the Promoter expressly consents to in writing (Eligible Entry):

5. There is one competition that Relevant Persons are entered into upon entry. There are two prizes to give away.
6. To enter, let us know your name, city, phone number and email. This is so if you are one of the two winners, School Road Publishing will be able to contact you.
7. Winners must redeem their prize by 31/12/21. Prize will not be accepted after this date.
8. The Promoter reserves the right, at any time, to verify the validity of entries and to disqualify any if an authorised representative submits an entry that is not in accordance with these Terms and Conditions or tampers with the entry process. Errors and omissions will not be accepted by the Promoter. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
9. Incomplete or indecipherable entries will be deemed invalid.
10. The prize includes two (2) nights accommodation at the Airedale Boutique Suites including a 3-course dinner for two at the Trocadero Restaurant & Bar with one beverage per person and breakfast served in the Trocadero Restaurant the following morning; complimentary valet parking for one car. The prize does not include flights, transport or any other related expenses not aforementioned.
11. Nights at the Airedale Boutique Suites to be taken consecutively and based on two people sharing one room.
12. Prize is non-transferable and not redeemable for cash.
13. Prize subject to availability at time of booking and must be redeemed by 31 December 2021.
14. Winners will be drawn and notified via email by 04/06/21. If winners can not be contacted by 09/06/21, Promoter’s will draw new winners. The Promoter’s decision is final and no correspondence will be entered into.
15. Authorised individuals who enter the Promotion, consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
16. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any authorised representative; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Law Act 2010 (Cth), or Consumer Guarantees Act 1993 (NZ), or Fair Trading Act 1986 (NZ), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of New Zealand (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by an Eligible Business; or (f) use of the Prize.
19. The Promoter collects personal information of authorised representatives in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, Prize suppliers and, as required, to New Zealand regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the authorised representative. A request to opt out, access, update or correct any personal information held by School Road Publishing in connection with this Promotion by an authorised representative of an Eligible Business, should be directed to School Road Publishing, info@schoolroad.nz.
22. All entries become the property of the Promoter.
